5.2. The concerned users or their licensors retain ownership of all rights, title and interest in and to their Third-Party Content.

二、注冊義務

“家住美國”平臺運用自己的操作系統(tǒng)通過國際互聯(lián)網(wǎng)為用戶提供網(wǎng)絡服務。同時，用戶必須承擔如下責任：

(1) 自行配備上網(wǎng)的所需設備，包括個人電腦、個人無線終端、調(diào)制解調(diào)器或其他必備上網(wǎng)裝置；

(2) 自行負擔個人上網(wǎng)所支付的與此服務有關的電話費用、網(wǎng)絡費用。

為了能使用本服務，用戶務必同意以下事項：

(3) 您注冊的用戶名不能侵犯他人合法權益，不能對他人名譽權造成侵犯。“家住美國”平臺有權收回對他人合法權益有侵犯嫌疑的帳號。

尊重用戶個人隱私是“家住美國”平臺的一項基本政策。所以，“家住美國”平臺不會在未經(jīng)合法用戶授權時，公開、編輯或透露其個人信息及保存在“家住美國”平臺中的非公開內(nèi)容，除非有下列情況：

(5) 另外，“家住美國”平臺會采取行業(yè)慣用措施保護用戶信息的安全，但“家住美國”平臺不能確信或保證任何個人信息的安全性，用戶須自己承擔風險。比如用戶聯(lián)機公布可被公眾訪問的個人信息時，用戶有可能會收到未經(jīng)用戶同意的信息；“家住美國”平臺的合作伙伴和可通過“家住美國”平臺訪問的第三方因特網(wǎng)站點和服務；通過抽獎、促銷等活動得知用戶個人信息的第三方會進行獨立的數(shù)據(jù)收集工作等活動。“家住美國”平臺對用戶及其他任何第三方的上述行為，不承擔任何責任。

四、用戶信息的存儲與限制

“家住美國”平臺不對用戶所發(fā)布信息的刪除或儲存失敗負責。“家住美國”平臺并不承諾對用戶的存儲信息進行無限期保留。除非本協(xié)議中另有規(guī)定，否則“家住美國”平臺不保證服務一定會滿足用戶的使用要求，也不保證服務不會受中斷，對服務的及時性、安全性、準確性也不作擔保。“家住美國”平臺有判定用戶的行為是否符合“家住美國”平臺服務條款的要求和精神的保留權利，如果用戶違背了服務條款的規(guī)定，“家住美國”平臺有中斷對其提供網(wǎng)絡服務的權利。同時，“家住美國”平臺運用自己的操作系統(tǒng)通過國際互聯(lián)網(wǎng)向用戶提供豐富的網(wǎng)上資源，包括各種信息工具、網(wǎng)上論壇、個性化內(nèi)容等。除非另有明確規(guī)定，增強或強化目前服務的任何新功能，包括新產(chǎn)品、欄目，均無條件地適用本服務條款。

五、服務條款的修改

“家住美國”平臺有權在必要時修改服務條款。“家住美國”平臺服務條款一旦發(fā)生變動，將會在重要頁面上提示所修改的內(nèi)容。如果不同意所改動的內(nèi)容，用戶可以主動取消獲得的網(wǎng)絡服務。如果用戶繼續(xù)享用網(wǎng)絡服務，則視為接受服務條款的變動。“家住美國”平臺保留隨時修改或中斷服務而不需告知用戶的權利。“家住美國”平臺行使修改或中斷服務的權利，不需對用戶或第三方負責。

六、拒絕提供擔保

用戶對網(wǎng)絡服務的使用承擔風險。“家住美國”平臺對此不作任何類型的擔保，不論是明確的或隱含的，但是不對商業(yè)性的隱含擔保、特定目的和不違反規(guī)定的適當擔保作限制。

七、有限責任

“家住美國”平臺對任何直接、間接、偶然、特殊及繼起的損害不負責任，這些損害可能來自：不正當使用網(wǎng)絡服務，在網(wǎng)上購買商品或進行同類型服務，在網(wǎng)上進行交易，非法使用網(wǎng)絡服務或用戶傳送的信息有所變動。

八、服務的結(jié)束

九、用戶管理

用戶單獨承擔發(fā)布內(nèi)容的責任。用戶對服務的使用是根據(jù)所有適用于“家住美國”平臺的法律、法規(guī)及相關政策標準的。

用戶必須遵循：

(1) 從中國境內(nèi)向外傳輸技術性資料時必須符合中國有關法規(guī)；

(2) 使用網(wǎng)絡服務不作非法用途；

(3) 不干擾或混亂網(wǎng)絡服務；

(4) 遵守所有使用網(wǎng)絡服務的網(wǎng)絡協(xié)議、規(guī)定、程序和慣例。

(5) 用戶的密碼和帳號遭到未授權的使用或發(fā)生其他任何安全問題，用戶可以立即通知“家住美國”平臺，并且用戶在每次連線結(jié)束，應結(jié)束帳號使用，否則用戶可能得不到“家住美國”平臺的安全保護。

(6) 禁止用戶從事以下行為：

1) 上載、張貼、發(fā)送或傳送任何非法、政治偏見、淫穢、粗俗、猥褻的，脅迫、騷擾、中傷他人、誹謗、侵害他人隱私或詆毀他人名譽或商譽的，種族歧視、危害未成年人或其他不適當?shù)男畔⒒螂娮余]件，包括但不限于資訊、資料、文字、軟件、音樂、照片、圖形、信息或其他資料（以下簡稱內(nèi)容）。

2) 未經(jīng)“家住美國”平臺許可的廣告行為。

3) 冒充任何人或機構，或以虛偽不實的方式謊稱或使人誤認為與任何人或任何機構有關。

4) 偽造標題或以其他方式操控識別資料，使人誤認為該內(nèi)容為“家住美國”平臺所傳送。

5) 上載、張貼、發(fā)送電子郵件或以其它方式傳送無權傳送的內(nèi)容（例如內(nèi)部資料、機密資料）。

6) 上載、張貼、發(fā)送電子郵件或以其它方式傳送侵犯任何人的專利、商標、著作權、商業(yè)秘密或其他專屬權利之內(nèi)容。

7) 在“家住美國”平臺提供的專供張貼廣告的區(qū)域之外，上載、張貼、發(fā)送電子郵件或以其他方式傳送廣告函件、促銷資料、“垃圾郵件”等。

8) 上載、張貼、發(fā)送電子郵件或以其他方式傳送有關干擾、破壞或限制任何計算機軟件、硬件或通訊設備功能的軟件病毒或其他計算機代碼、檔案和程序之資料。

9) 干擾或破壞本服務或與本服務相連的服務器和網(wǎng)絡，或不遵守本服務協(xié)議之規(guī)定。

10) 故意或非故意違反任何相關的法律、法規(guī)、規(guī)章、條例等其他具有法律效力的規(guī)范。

11) 跟蹤或以其他方式騷擾他人。

12) 其它被“家住美國”平臺視為不適當?shù)男袨椤?/span>
另外，用戶對經(jīng)由本服務上載、張貼、發(fā)送電子郵件或傳送的內(nèi)容負全部責任；對于經(jīng)由本服務而傳送的內(nèi)容，“家住美國”平臺不保證前述內(nèi)容的正確性、完整性或品質(zhì)性。用戶在接受本服務時，有可能會接觸到令人不快、不適當或令人厭惡的內(nèi)容。在任何情況下，“家住美國”平臺均不對任何內(nèi)容負責，包括但不限于任何內(nèi)容發(fā)生任何錯誤或紕漏以及衍生的任何損失或損害。“家住美國”平臺有權（但無義務）自行拒絕或刪除經(jīng)由本服務提供的任何內(nèi)容。用戶使用上述內(nèi)容，應自行承擔風險。
“家住美國”平臺有權利在下述情況下，對內(nèi)容進行保存或披露：

3) 被侵害的第三人提出權利主張；

十、用戶的廣告宣傳

用戶在自己發(fā)表的信息中加入宣傳資料或參與廣告策劃，在“家住美國”平臺的免費服務上展示他們的產(chǎn)品，任何這類促銷方法，包括運輸貨物、付款、服務、商業(yè)條件、擔保及與廣告有關的描述都只是在相應的用戶和廣告銷售商之間發(fā)生。“家住美國”平臺不承擔任何責任，“家住美國”平臺沒有義務為這類廣告銷售負任何一部分的責任。同時，如果該行為未經(jīng)“家住美國”平臺同意或者對“家住美國”平臺產(chǎn)生利益侵犯，“家住美國”平臺有權利進行刪除、屏蔽，以及采取相應的技術、法律手段阻止此類信息的發(fā)布。

十一、關于用戶在“家住美國”平臺的公開使用區(qū)域的內(nèi)容

“公開使用區(qū)域”包括網(wǎng)上論壇、留言版、評論區(qū)和其它一般公眾可以使用的網(wǎng)絡內(nèi)容區(qū)域；用戶一旦在本服務公開使用區(qū)域張貼內(nèi)容，即視為用戶授予“家住美國”平臺該內(nèi)容著作權之免費及非獨家許可使用權，“家住美國”平臺有權為展示、傳播及推廣前述張貼的內(nèi)容之服務目的，對上述內(nèi)容進行復制、修改、出版。

由此展示、傳播及推廣行為所產(chǎn)生的損失或利潤，均由“家住美國”平臺承擔或享受。“家住美國”平臺有權自主決定是否給予此類用戶鼓勵或獎勵。

因用戶進行上述張貼，而導致任何第三方提出索賠要求或衍生的任何損害或損失，用戶須承擔全部責任，本網(wǎng)站概不負責。

其他訪問者或者企業(yè)、單位，未經(jīng)“家住美國”平臺授權，不得對他人張貼在公開使用區(qū)域或本服務其他內(nèi)容進行復制、出售或用作其他商業(yè)用途。

十二、關于手機服務

(1) “家住美國”平臺為用戶提供“家住美國”平臺手機短信服務。一旦用戶在注冊本服務的過程輸入自己的手機號碼和保護碼并完成登記注冊程序，則表明用戶愿意接受“家住美國”平臺發(fā)送的短信，此服務為免信息費服務，“家住美國”平臺不向用戶收取任何費用，用戶主動發(fā)送的短信產(chǎn)生的費用，由用戶向移動運營商支付，與“家住美國”平臺無關。若用戶通過注冊并使用了“家住美國”平臺的收費短信服務，則表示用戶同意通過運營商支付信息費給“家住美國”平臺，此服務產(chǎn)生的信息費由運營商代為收取。手機短信服務的具體收費說明見具體服務的相應頁面。

(2) “家住美國”平臺為用戶提供手機上網(wǎng)服務，其站點為(http://www.6azz.com)以及和“家住美國”平臺合作的合作站點。“家住美國”平臺不收取用戶任何費用，用戶上網(wǎng)產(chǎn)生可能產(chǎn)生的流量費，由用戶向運營商支付，與“家住美國”平臺無關。

(3) “家住美國”平臺不承擔用戶由于手機故障、欠費、丟失、借用或盜用后他人利用手機訂購“家住美國”平臺短信息服務而遭受的損失或并非由于“家住美國”平臺的原因而導致的任何其它損失。對于用戶出國并使用國際漫游服務但未取消已定制的短信息服務，或者在國際漫游狀態(tài)下繼續(xù)使用短信息點播服務，用戶應當承擔相關所有費用，“家住美國”平臺不承擔任何責任。

(4) 用戶自己承擔系統(tǒng)受損或資料丟失的所有風險和責任。“家住美國”平臺對于刪除和存儲數(shù)據(jù)失敗并不負有任何責任。

(5) 如因“家住美國”平臺的過錯，導致用戶接收到錯誤的信息并支付了不應支付的信息費，“家住美國”平臺的全部責任僅限于賠償用戶因錯誤信息而支付的信息費。

十三、關于鏈接

本服務可能會提供與其他國際互聯(lián)網(wǎng)網(wǎng)站或資源進行鏈接。對于前述網(wǎng)站或資源是否可以利用，“家住美國”平臺不予擔保。因使用或依賴上述網(wǎng)站或資源所產(chǎn)生的損失或損害，“家住美國”平臺也不承擔任何責任。

十四、“家住美國”平臺的知識產(chǎn)權及其他權利

經(jīng)由本服務傳送的資訊及內(nèi)容，受到著作權法、商標法、專利法或其他法律的保護；未經(jīng)“家住美國”平臺明示授權許可，用戶不得進行修改、出租、散布或衍生其他作品，用戶本人創(chuàng)作并在公開使用區(qū)域張貼的內(nèi)容除外。

用戶對本服務所使用的軟件有非專屬性使用權，但自己不得或許可任何第三方復制、修改、出售或衍生產(chǎn)品。

“家住美國”平臺、“家住美國”平臺設計圖樣以及其他“家住美國”平臺圖樣、產(chǎn)品及服務名稱，均為“家住美國”所享有的商標及相關知識產(chǎn)權，未經(jīng)“家住美國”事先書面授權，任何人不得使用、復制或用作其他用途。

十五、免責聲明

“家住美國”平臺對于本服務包含的或用戶經(jīng)由或從任何與本服務有關的途徑所獲得的任何內(nèi)容、信息或廣告，不聲明或保證其正確性或可靠性；并且對于用戶經(jīng)本服務上的廣告、展示而購買、取得的任何產(chǎn)品、信息或資料，“家住美國”平臺不負保證責任。用戶自行承擔使用本服務的風險。

(1) “家住美國”平臺有權但無義務，改善或更正本服務任何部分之任何疏漏、錯誤。

(2) “家住美國”平臺不保證以下事項（包括但不限于）：

1) 本服務適合用戶的使用要求；

2) 本服務不受干擾，及時、安全、可靠或不出現(xiàn)錯誤；

3) 用戶經(jīng)由本服務取得的任何產(chǎn)品、服務或其他材料符合用戶的期望；

4) 用戶使用經(jīng)由本服務下載的或取得的任何資料，其風險自行負擔；因該使用而導致用戶電腦系統(tǒng)損壞或資料流失，用戶應負完全責任；

5) 對基于以下原因而造成的利潤、商業(yè)信譽、資料的損失或其他有形或無形損失，“家住美國”平臺不承擔任何直接、間接、附帶、衍生或懲罰性的賠償；

6) 服務使用或無法使用；

7) 經(jīng)由本服務購買或取得的任何產(chǎn)品、資料或服務；

8) 用戶資料遭到未授權的使用或修改；

9) 其他與本服務相關的事宜。

(3) 用戶在瀏覽網(wǎng)際網(wǎng)路時自行判斷使用“家住美國”平臺的檢索目錄。該檢索目錄可能會引導用戶進入到被認為具有攻擊性或不適當?shù)木W(wǎng)站，“家住美國”平臺沒有義務查看檢索目錄所列網(wǎng)站的內(nèi)容，因此，對其正確性、合法性、正當性不負任何責任。

(4) 用戶必須同意對于“家住美國”平臺向用戶提供的下列產(chǎn)品或者服務的質(zhì)量缺陷本身及其引發(fā)的任何損失，“家住美國”平臺無需承擔任何責任：

1) “家住美國”平臺向用戶免費提供的各項網(wǎng)絡服務；

2) “家住美國”平臺向用戶贈送的任何產(chǎn)品或者服務；

3) “家住美國”平臺向收費網(wǎng)絡服務用戶附贈的各種產(chǎn)品或者服務。

十六、法律

網(wǎng)絡服務條款要與中華人民共和國的法律解釋相一致，用戶和“家住美國”平臺一致同意服從由中華人民共和國法律規(guī)定的有管轄權的法院進行管轄。如發(fā)生“家住美國”平臺服務條款與中華人民共和國法律相抵觸時，則這些條款將完全按法律規(guī)定重新解釋，而其它條款則依舊保持對用戶產(chǎn)生法律效力和影響。

在任何情況下，“家住美國”平臺用戶不得利用“家住美國”平臺進行違反或可能違反國家法律和法規(guī)的言論或行為，否則，“家住美國”平臺可在任何時候不經(jīng)任何事先通知終止向用戶提供服務。并且用戶對自己的言論或行為負責。

用戶應遵守以下法律及法規(guī)：

(1) 用戶同意遵守《中華人民共和國保守國家秘密法》、《中華人民共和國計算機信息系統(tǒng)安全保護條例》、《計算機軟件保護條例》、信息產(chǎn)業(yè)部2000年10月8日第4次部務會議通過的《互聯(lián)網(wǎng)電子公告服務管理規(guī)定》，以及《互聯(lián)網(wǎng)新聞信息服務管理規(guī)定》等有關計算機及互聯(lián)網(wǎng)規(guī)定的法律和法規(guī)、實施辦法。在任何情況下，“家住美國”平臺合理地認為用戶的行為可能違反上述法律、法規(guī)，“家住美國”平臺可以在任何時候，不經(jīng)事先通知終止向該用戶提供服務。

(2) 用戶應了解國際互聯(lián)網(wǎng)的無國界性，應特別注意遵守當?shù)厮杏嘘P的法律和法規(guī)。

1．個人信息的利用目的

１）關于間接取得，或者以書面以外的形式取得

　　(3) 通過微信取得的個人信息
　　　　為了根據(jù)客人的意愿，向房地產(chǎn)中介業(yè)者提供中介業(yè)務所需的相關客戶信息
　　　　為了使客戶能更順利地進行交易
　　　　為了廣告，宣傳和市場開拓工作
　　　　為了提供其他我司服務或附屬服務

2．關于向第三方提供個人信息
　　將客戶的個人信息，在客戶希望和同意的基礎上，為了達成以上第1項2）（2）和第1項2）（3）的利用目的，通過包括書面，郵寄，電話，電子郵件，網(wǎng)絡的方式，提供給客戶詢問的房地產(chǎn)中介。
　　以上向第三方提供的個人信息是指，姓名，電話號碼，郵件，微信號碼。

3．關于個人信息的委托
　　存在委托處理個人信息的處理事宜的情況。關于委托，為了保證受托方對個人信息采取安全的管理，我司將對受托方進行必要和適宜的監(jiān)督。

4．關于持有個人信息事宜的公告
　　我司接收關于通知個人信息利用目的，提供，內(nèi)容修正，追加或者刪除，利用停止，消除，或者停止給第三方提供個人信息的要求。以下的【個人信息投訴和咨詢窗口】網(wǎng)站欄目負責上述相關事宜。

5．關于提供個人信息的的任意性
　　個人信息的提供是任意的。但是如果客戶沒有提供必要的信息，可能無法做出適當?shù)幕貜汀?/span>

　　為了調(diào)查統(tǒng)計我司網(wǎng)站的被利用狀況，我司將取得cookie等信息，該行為不取得或利用個人信息。
